By submitting photographs to the open call “ZIMA Photo” you (the “Submitter”) agree to have fully read, understood and acknowledged these Conditions of Participation. These Conditions of Participation constitute the agreement between the Submitter and ZIMA Magazine, registered name of Articulate Communications Agency Ltd.

1. THEME

The theme of the competition is “Streets and Faces”. Submit images that you have either taken recently or re-edited images from your archive that illustrate the topic.

2. DEADLINE

The submission deadline for “ZIMA Photo” is 17 April 2021 (23:59 BST). ZIMA Magazine reserves the right to adjust this deadline at any time.

3. CONDITIONS OF PARTICIPATION

Submitter must be over 18 and under 36 years old.

4. SUBMITTABLE PHOTOGRAPHS AND PROJECT DESCRIPTION

Every Submitter can submit between 5 and 8 photographs and a description of the project in up to 200 words in English or Russian. On the intro-page of the competition you can find a detailed explanation of technical requirements.

5. SUBMITTED PHOTOGRAPHS

5.1 PUBLICATION OF SUBMITTED PHOTOGRAPHS

The Submitter authorizes ZIMA Magazine to publish selected submitted photographs on the corresponding website zimamagazine.com, social media accounts of zimamagazine and on the platforms of the partners of competition. The Submitter also authorizes ZIMA Magazine to use selected submitted photographs for a dedicated exhibition or/and event. The Submitter agrees that selected images can be used for promotion (online and print) for ZIMA Magazine. The submitter will always be given credit in any kind of publication. Furthermore, the Submitter agrees that only ZIMA Magazine may take decisions about how to integrate photographs into the websites as well as eventually print publications of the respective partners (ZIMA Magazine, СОБАКА.RU, Splento etc.). The Submitter agrees that submitted photographs may be put into new contexts with other photographs and literary texts and presented next to each other. The Submitter notes that ZIMA Magazine does not guarantee a publication of a Submitter’s submitted photographs. The Submitter acknowledges to have no claim on remuneration for published photographs.

5.2 ARCHIVING SUBMITTED PHOTOGRAPHS

The Submitter agrees that the digital versions of submitted photographs for “ZIMA Photo” will be archived for possible future inclusion in any possible programmatic events and platforms – regardless of a publication. The Submitter may revoke this consent via e-mail to contact@zimamagazine.com at any time.

In the event of a revocation the respective photographs will be deleted within 20 business days after the deadline.

5.3. VIOLATION OF RIGHTS

The Submitter is completely reliable for the submitted content. In respect to the theme “The world after lockdown” (see 1), no images may violate international law under any circumstances.

6. PERSONAL DATA

6.1 PUBLICATION OF PERSONAL DATA

The Submitter agrees that in case of selection, his/her full name and respective URL will be published on the websites of ZIMA Magazine and partners of the competition. Further contact information will not be published. Without the submitters explicit consent.

6.2 STORAGE OF PERSONAL DATA

All personal data that has been inserted during the registration and submission process will be stored for Submitter and image administration, curation, organization and statistical reasons. Any kind of statistical data collection is only executed and used in anonymized forms. ZIMA Magazine’s privacy policy applies.

7. DECLARATION OF COPYRIGHT

The Submitter assures to be the sole copyright owner of all submitted photographs. Submitters are only entitled to submit photographs from third parties if he/she owns an explicit authorization by the respective copyright holder.

8. AUTHORIZATION FOR A PUBLICATION

The Submitter assures to have the explicit consent of all people who are pictured on submitted photographs (in case of children of their legal guardian) to be submitted to and published. In case of e.g. street photography, the Submitter has to decide on his/her own and take all responsibility for a publication and further processing of his/her submitted photographs. The Submitter assures to have the right to submit pictures of places, buildings, landscapes, military sites or operations, means of transport, goods, persons in order to be published as described in these Conditions of Participation.

9. DISCLAIMER

The Submitter declares to be completely liable for his/her submitted photographs.

The Submitter indemnifies ZIMA Magazine from any claims of third parties caused by the violation of these Conditions of Participation.

10. SEVERANCE CLAUSE

Unenforceability or invalidity of one or more clauses in these Conditions of Participation shall not have an effect on any other clause in these Conditions of Participation. If it is possible, any unenforceable or invalid clause in these Conditions of Participation shall be modified to show the original intention of the parties.

11. JURISDICTION & APPLICATION OF LAW

Place of general jurisdiction is London, United Kingdom. UK law is applied.
